1. Acceptance of Terms

By accessing or using HungryShot ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

HungryShot is an AI-powered SaaS photo and video studio for restaurants, cafés, bars, bakeries, cloud kitchens, food trucks and caterers. It transforms photos of dishes and drinks into studio-quality food images and short videos, and writes dish names, menu descriptions, captions and hashtags, for use on menus, delivery apps, websites and social media.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect at any time with reasonable notice.

HungryShot is an independent product. Uber Eats, DoorDash, Deliveroo, Just Eat, Glovo, Instagram, TikTok, Facebook, Google and other platform names are trademarks of their respective owners and are used only to describe compatibility or export formats; HungryShot is not affiliated with or endorsed by them.

3. Account Registration

You must create an account to access the Service. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorised access
  • Be responsible for all activity that occurs under your account

    • You must be at least 16 years old to use the free plan and at least 18 years old (or the age of majority where you live) to buy a paid plan or credit pack.

    4. Subscription & Payment

    HungryShot is offered through paid subscriptions (monthly or annual) and optional credit packs. The seller is [Company legal name]. Payments are processed by Stripe (Stripe Payments Europe, Limited, or its affiliate Stripe, Inc., depending on your location). By subscribing to a paid plan:

  • You authorise us, through Stripe, to charge your payment method on a recurring basis (monthly or annually) until you cancel
  • Subscriptions renew automatically at the then-current price unless cancelled before the renewal date
  • The price, currency and any applicable taxes are shown at checkout before you pay; we may change prices for future renewals with at least 30 days' notice
  • You can cancel at any time from Studio → Billing → Cancel plan; cancellation stops future renewals and access continues until the end of the paid period
  • Refunds are governed by our Refund Policy: /refund
  • If a payment fails, Stripe may retry the payment; we may restrict paid features until payment succeeds

    • We do not store your card details. Stripe's own terms and privacy policy (https://stripe.com/privacy) apply to the processing of your payment.

    5. Credits & Usage

    Each plan includes a monthly credit allowance for AI generations, and you may buy additional credit packs. Credits are a prepaid usage allowance for the Service. They:

  • Have no cash value and cannot be transferred, sold or exchanged for cash, except where our Refund Policy or applicable law provides otherwise
  • Monthly plan credits reset on each billing anniversary. Purchased credit-pack credits expire one month after purchase; any unused pack credits are removed at expiry. Promotional or referral credits follow the terms shown when offered
  • Are non-transferable
  • Are restored to your balance if a generation fails because of a technical error on our side. This restores credits and is not a cash refund
  • May be granted as free sign-up or referral rewards, which carry no monetary value and may be changed or withdrawn for abuse

    • 6. Acceptable Use

    You may not use HungryShot to:

  • Upload or generate images of illegal, prohibited or unsafe products, or of food presented in a deceptive way
  • Generate or publish misleading food-safety, allergen, nutrition, halal, kosher, organic or origin claims
  • Upload or generate images of real people without their explicit consent, or create face swaps, deepfakes, voice impersonations or content that imitates a real person
  • Impersonate or imitate a real restaurant, brand, logo or trademark that you are not authorised to use
  • Attempt to reverse-engineer, scrape, or abuse our AI systems
  • Resell or sublicense access to the Service
  • Use the Service for any unlawful purpose or in violation of the rules of the delivery apps, platforms or advertising channels where you publish

    • You are responsible for the accuracy of the menus, prices and descriptions you publish and for the legal compliance of your food advertising. The full rules are in our Acceptable Use Policy (/acceptable-use). Violations may result in immediate account suspension without refund.

    7. Intellectual Property

    You retain full ownership of the content you upload, such as dish photos, menus, logos and other brand assets. You grant [Company legal name] a limited, non-exclusive licence to process this content solely for the purpose of delivering the Service. You confirm that you own it or have the right to use it.

    The AI-generated outputs (food images, videos, dish names, menu descriptions, captions) are provided to you under a commercial licence for use in your own business, including menus, delivery apps, websites, advertising and social media.

    The platform, software, AI models, brand, interfaces and documentation belong to [Company legal name], which grants you a personal, non-exclusive, non-transferable right of use for the duration of your subscription.

    8. Disclaimer of Warranties

    The Service is provided on an "as is" and "as available" basis. HungryShot makes no warranties, express or implied, regarding:

  • The accuracy or completeness of AI-generated content
  • Uninterrupted or error-free operation
  • Results or outcomes from using the Service (including actual orders or sales increases)
  • That an AI-generated image or video will exactly match the real dish you serve

    • AI-generated images, videos and menu copy should always be reviewed before publication.

    9. Limitation of Liability

    [Company legal name]'s liability is limited to direct damages and, to the maximum extent permitted by law, shall not exceed the amounts you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential losses, nor for force majeure events or the acts of third parties.

    10. Termination

    You may cancel your subscription at any time. [Company legal name] may terminate the agreement by giving you 30 days' notice, and may suspend or terminate it immediately for a serious breach that is not corrected. When you cancel a subscription, access continues until the end of the paid billing period and the account itself remains open. Cancellation does not delete saved content. You can export or delete your account from Studio > Settings. When you delete your account, we delete saved content from active systems, except records we must retain by law; backup copies may remain until overwritten in our normal backup cycle.

    11. Governing Law

    These Terms are governed by the laws of [Governing law jurisdiction]. The parties will first try to resolve any dispute amicably; failing that, the courts of [Competent courts] have jurisdiction, except where mandatory consumer law grants you the right to bring proceedings in your country of residence.

    12. AI-Generated Content

    Images, videos, people and text produced by the Service are generated by artificial intelligence. Chefs, diners and other people created with the Service are entirely synthetic and are not based on any real person; any resemblance to a real person is coincidental.

  • AI renders may not exactly match the real dish, portion, ingredients or presentation you serve. You are responsible for reviewing outputs before use and for checking that they fairly represent your product
  • Do not use AI imagery in a way that misrepresents the product actually served where local law or the rules of a delivery app, marketplace or advertising channel prohibit it, and comply with any requirement to disclose AI-generated or AI-edited images
  • Do not present AI-generated people as real chefs, staff, customers or reviewers in a way that could mislead diners
  • We do not verify, and the Service does not determine, allergen, nutrition, dietary, halal, kosher, organic or origin information; any such information you publish is your responsibility
  • We may label or embed metadata in outputs to indicate that they are AI-generated, and you must not remove it where the law requires it
  • Outputs may be inaccurate or similar to outputs produced for other users

    • 13. Sanctions and Export Controls

    You may not use the Service if you are located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, or if you are listed on a sanctions list that applies to us or to our payment provider. We may refuse orders from certain regions for the same reason.
